These Terms and Conditions ("Terms") govern your access to and use of FoodFaceoff (the "Service"), a platform operated by Beady Enterprises LLC ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet all eligibility requirements.
You agree to provide accurate, current, and complete information when creating your account and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
You retain ownership of any content you submit, upload, or display on the Service ("User Content"), including photographs, recipes, competition entries, and comments. By submitting User Content, you grant Beady Enterprises LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and improving the Service.
You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not infringe, misappropriate, or violate any third-party rights; and (c) your User Content complies with these Terms and all applicable laws.

We reserve the right, but not the obligation, to review, remove, or disable access to any User Content at our sole discretion without notice.
FoodFaceoff allows users to create and participate in food competitions. Prizes, if any, are set and fulfilled entirely by the competition creator, not by Beady Enterprises LLC. We are not responsible for the accuracy, legality, or delivery of any prizes advertised by competition creators. Participants enter competitions at their own risk. We reserve the right to remove any competition that violates these Terms or applicable law.
Certain features of the Service require a paid subscription ("Professional Plan"). By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current subscription price. All payments are processed by Stripe. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period. Fees are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to change subscription pricing with reasonable advance notice.
From time to time, we may offer promotional codes that provide temporary or discounted access to premium features. Promo codes are non-transferable, have no cash value, may not be combined with other offers, and are subject to additional terms communicated at the time of issuance. We reserve the right to revoke promo codes at any time if we suspect abuse or fraud.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Beady Enterprises LLC and its licensors. The FoodFaceoff name, logo, and all related marks are trademarks of Beady Enterprises LLC. You may not use our trademarks without prior written permission.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.
The Service may contain links to or integrations with third-party websites or services (including Stripe for payment processing and AWS for infrastructure). We do not control and are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BEADY ENTERPRISES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, INABILITY TO USE, OR RELIANCE ON THE SERVICE, EVEN IF BEADY ENTERPRISES LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, BEADY ENTERPRISES LLC EXPRESSLY DISCLAIMS ALL MONETARY LIABILITY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE SERVICE IS TO DISCONTINUE USE OF THE SERVICE.
You agree to indemnify, defend, and hold harmless Beady Enterprises LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination (including Sections 3, 8, 11, 12, 13, 15, and 16) shall survive.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts. You waive any right to a jury trial in any action arising under or related to these Terms.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by email or in-Service notification. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service.
These Terms constitute the entire agreement between you and Beady Enterprises LLC regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. You may not assign your rights under these Terms without our prior written consent.
